By submitting forms for electronic filing through Tax Form Hero LLC, I acknowledge and confirm the following:

  • I am authorized to act on behalf of the organization or company I represent for the purpose of filing tax forms.
  • I have reviewed the information provided in the forms and confirm that it is accurate, complete, and free of discrepancies to the best of my knowledge.
  • I understand that any errors or omissions may result in penalties or rejected filings by the IRS or state agencies.
  • I accept full responsibility for the accuracy of the data submitted and for ensuring compliance with all applicable federal and state regulations.
  • I authorize Tax Form Hero LLC to transmit the submitted forms to the IRS and/or relevant state authorities on behalf of the organization I represent.

Electronic Delivery of Recipient Copies – Filer Acknowledgment

The IRS permits electronic delivery of recipient copies for tax forms such as 1099, W-2, and 1042-S, provided specific compliance requirements are met. To ensure adherence to these regulations, Tax Form Hero LLC requires filers to acknowledge that they have obtained valid consent from each recipient prior to using the E-Delivery service.

IRS Compliance Requirements for E-Delivery

  • Affirmative Consent

    • The recipient must have explicitly agreed to receive their tax form electronically.
    • Consent must be obtained before the form is furnished.
    • The recipient must be able to access the form in the format provided (e.g., encrypted PDF).
    • Consent must be documented electronically or in writing and retained by the filer.
  • Required Disclosures Before Consent

    Filers must have informed recipients of:

    • Their right to receive a copy of paper if they do not consent
    • How to withdraw consent and request a paper copy
    • The duration and scope of the consent
    • Any hardware/software requirements to access the form
    • How to update their contact information
    • The timeframe during which the form will remain accessible online
  • Access and Availability

    • Forms must be made available to recipients no later than January 31 of the following tax year.
    • Recipients must be notified when the form is posted and provided instructions for access.

By selecting the E-Delivery option, you confirm that:

  • You have obtained affirmative consent from each recipient in accordance with IRS guidelines.
  • You have provided all required disclosures prior to obtaining consent.
  • You will retain documentation of consent for audit and compliance purposes.

“I confirm that I am an authorized payer of income subject to backup withholding under IRC Section 3406 and that I am permitted to use the IRS TIN Matching Program. I authorize Tax Form Hero LLC to submit the name/TIN combinations I have provided for verification against IRS records. I understand that this service is intended to reduce filing errors and potential penalties and that I am responsible for ensuring the accuracy of the data submitted.”
